A report by the Nuffield Council on Bioethics, contrary to the Declaration of Helsinki, permits most important research initiatives in developing countries.The Ethics of Research Related to Health Care in Developing Countries by the Nuffield Council on Bioethics makes a number of innovative recommendations that depart from codes such as the Declaration of Helsinki. It recommends that standards of care might be relativised to the standard of that nation. It recommends that very good reasons need to be given for not (...) giving post-trial access to medications but recognises that there may be justifiable instances of this. It is the view of the authors that these and other recommendations of the report are sensible pieces of advice given the complexities of the developing world. (shrink)

The purpose of this essay is to stimulate academic discussion about the ethical justification of using human primordial stem cells for tissue transplantation, cell replacement, and gene therapy. There are intriguing alternatives to using embryos obtained from elective abortions and in vitro fertilisation to reconstitute damaged or dysfunctional human organs. These include the expansion and transplantation of latent adult progenitor cells.

While the UK Home Office’s proposals to preventively detain people with what it has called dangerous severe personality disorder have been subjected to debate and criticism the deeply troubling jurisprudential issues in these proposals have not yet entered into public debate in a way that their seriousness deserves.1 It is good that a commentator as well known as Professor Szasz is speaking out on this issue.Professor Szasz focuses upon a crucial question by calling into question the medicalisation of terms like (...) dangerousness and mental illness.2 There is a great temptation for legislators and the public to treat these terms as if they are purely scientific terms and to think of risk assessment as a precise science. I don’t share Professor’s Szasz’s worry about how psychiatry is using these terms but I think there are some important questions about how these concepts function in the public sphere.This issue is important enough to justify the use of some rhetorical claims because such claims can serve to bring out what are neglected and important issues. In raising the following objections I am not attempting to refute the message that is in Szasz’s article or to say that he is not making an important point but rather to attempt to sharpen the issues and to suggest ways that we can respond to Professor Szasz’s challenge.Psychiatry has progressed in a number of ways since Professor Szasz wrote The Myth of Mental Illness.3 The science is much better, we have much better medications, and psychiatrists are acutely aware of the tension between treating their patient and their obligations to the public interest.So when Professor Szasz says: “Psychiatrists offer to relieve the disturbed person of the burden of coping …. Justice has always been regarded as one of the fundamental political virtues. No association of human individuals could subsist, says Hume, “were no regard paid to the laws of equity and justice”, and nearly every thinker who has turned to consider human society, has reached the same conclusion. Yet we are not at all clear what justice is, nor why it is so important. There are many other ideals which a society may cherish, and often reformers have felt impatient of (...) having to compromise their aims merely for the sake of justice, and have not seen why the claims of justice should in any way override other political goods. I shall try to show why justice is, along with liberty, a peculiarly fundamental ideal, which is not merely co-ordinate with other ideals a society may value; but also that this notwithstanding, considerations of justice are not all-sufficient, and do not, and should not, always override all other political ideals. NICE, the draft fertility guideline and dodging the big question: should fertility treatment be provided by the NHS?In August of this year the National Institute for Clinical Excellence made its draft guideline on fertility treatment available for consultation.1 As has been widely reported in the media the draft guideline recommends that the National Health Service should provide publicly funded fertility treatment in a consistent way across England and Wales. The guideline recommends that three cycles of IVF should be available when (...) “The woman is within the optimal range for in vitro fertilisation and there is an appropriately diagnosed cause of infertility of any duration, or unexplained infertility of at least three years’ duration .Those who need fertility treatment will celebrate the guideline, as will many fertility clinics. The guideline does not, however, address key questions that will be obvious to many. Is fertility treatment the kind of thing that ought to be available on the NHS? Will the inevitable increase in demand mean that resources are directed away from other services? Is fertility treatment really the same kind of intervention as heart or hip replacement surgery?My view is that there are good reasons for doing what we can to help people access fertility services. Most of us will start a family and for those of us who do it is probably the most important of all of our life projects. Given that social status and wealth can be significant obstacles to many of the things that people would like to do with their lives, the fact that most of us are able to pursue this important life project is good from an egalitarian …. This article demonstrates the benefit of studying a classical version of chromodynamics in order to better understand color charge in quantum chromodynamics. Standard presentations of the conservation and confinement of color charge serve to obscure the Lie-algebra-valued character of the conserved Noether charge. This article shows how we can remove these obscuring factors by studying color charge from the vantage point of classical chromodynamics. This key example of color charge illustrates the larger methodological benefit of this classical vantage point: interpreting (...) classical gauge theories helps to delineate the uniquely quantum features of quantum field theories. Many of the original Saturday Night Live (SNL) cast and writers believed that cocaine was non‐addictive and that it was a logical drug to use to sustain the long hours of intense preparation necessary for a weekly live show. It's no secret that drugs and alcohol have been fuel for some SNL cast members. In the early days, the culture and writing of SNL were fueled by drugs, particularly cocaine and marijuana. So John Belushi's drug use was not at all (...) unique, and it justified his belief that people in the entertainment business needed to do drugs to cope with pressure and stress. Sadly, though, John and Chris Farley both lost their lives to overdoses at the young age of 33. Although Stuart Smalley pokes fun at the Pollyanna tone of recovery gurus, Al Franken himself has been a great advocate for the kind of twelve‐step programs that Chris Farley succeeded with for a time. The problem with which I wish to deal in this paper is the problem of singular reasons in the humanities, whether they exist, or rather, whether they can exist: for it would seem that the word “reason” carried with it some idea of generality, so that the phrase “singular reason” was a contradiction in terms, a specification which could never be fulfilled. But humanists are always sensing the singularity of their studies: and the philosopher wondering about the nature of humane (...) thinking either must conclude that it is really only inadequate science, its singularity being the mark of the fact that we never really have an adequate basis for any of our generalizations, an unfortunate reminder that the whole structure is built on the shakiest of inductive foundations; or , if he is unwilling to allow that humanists are just bad, or at least amateur, scientists, he is tempted to vindicate the rationality of their reasoning by inventing a special faculty of particular ratiocination which is able to perceive particular truths—the intuition of the moralists or the insight of the Collingwoodian mode. An obligation may take either of two forms, each form being reported in a different way. For example, when we report the obligation of parents to care for their children, if it is the moral obligation we mean, we will say ‘Parents ought to look after their children’ but if we mean the legal obligation, we will say ‘Parents have to look after their children’. Though it is frequently pointed out that Whitehead’s process philosophy is a hermeneutic philosophy, the author makes the additional claims that the philosophical hermenutics of the 19th and 20th centuries are frequently process philosophies. This is especially true of Paul Ricoeur’s interpretation theory, which describes the ego as engaged in an unending transformative dialectic process with its environment. This insight, coupled with Ricoeur’s insistence on the efficacy of a pre-linguistic reality upon experience, makes him a provocative conversation partner for Whiteheadians (...) and uncovers the possibility of a process metaphysic arising out of the “subjectivist” programs of phenomenology and linguistic analysis. The purpose of this note is to defend the following reading, offered by a minority of manuscripts, at Sat. 6.6. Even if the evidence of the manuscripts showed merely that egregius… senes was an eleventh-century conjecture which gained a very moderate degree of acceptance, the reading would still have much to commend it.

It seems to me certain that the perception of foreign bodies of a certain sort, although a necessary, is not the only, part of the basis of our belief in other persons. The greatest disagreement with this view that I know of has been expressed by Professor Aaron in a paper published in Philosophy , XIX, 72. He claims that, since one does not really know “what it means to be a mind in one's own case,” the question whether we (...) can be certain that there are other minds is meaningless except as reducible to the question whether such propositions as “Robinson exists” are propositions which we can be certain about. And he tries to show that no more is involved in the analysis of “Robinson exists” than would be involved in the analysis of propositions of whose truth we can be perceptually certain, such as “That table over there exists” or “The Eiffel Tower exists.” My assurance that Robinson exists is not the assurance that something called Robinson's mind exists. It is the perfectly ordinary perceptual assurance that ‘the person over there’ exists. “You ask me how I am certain that Robinson exists and I answer, ‘Well, look, there he is.’ It would be absurd for anyone to say that he does not exist when I see him here before me and hear him talk and watch him move that chair.”. Though the authors of this commentary have deep felt doubts about the fruitfulness of Björkman and Hansson’s analysis of bodily rights, they do not doubt their capacity to develop both creative and provocative thoughtsIt is always welcoming to be confronted with thoughts that, even though one wholeheartedly disagrees with them, have the effect of stimulating one’s own reflections on matters, which without such confrontations, would have been less distinct, less critical—and we would gladly admit, less polemical. Thus it is thanks (...) to Barbro Björkman and Sven Ove Hansson’s article, “Bodily rights and property rights”, that we have been able to set our present course into these murky waters. The issue they want to address is by no means of a kind that lends itself easily to theoretical speculation. This has, perhaps, as much to do with the inherent intricacy of the issue itself as with the controversy it has managed to arouse. The issue is: is it possible to have ownership over one’s own body—that is, is it appropriate to treat the body and its components as property? What are the implications of conceptualising the body and its parts in terms of property? Should one, as a general rule, be able to sell and buy human biological material? If so, who should be allowed to buy and sell it? Does the sale or donation of one’s own bodily parts imply a transfer of ownership rights to the buyer or receiver, or is it rather that ownership of human bodily parts can only be acquired after the material has been, say, manipulated in a laboratory?Contrary to Björkman and Hansson, who see “the primary normative issue” to be “what combination of rights a person should have to a particular item of biological material”, we believe that their decision to construe …. There are many challenges to be met when writing an introductory treatise on an academic topic. The subject matter must be presented in a simple but not oversimplified manner. Enough theory must be included to ground the discussion of specific issues but not so much as to overwhelm or bore the readers. The text should be long enough to do justice to the subject matter but short enough to be readily accessible, especially for readers such as healthcare professionals, whose primary (...) concerns lie elsewhere.There are additional challenges in a relatively novel interdisciplinary field such as bioethics. The scope and methodology of bioethics are matters of great controversy, as are its relations with related subjects such as professionalism and human rights. The field is so broad that a single author cannot claim expertise on all topics. Rivalries between law and ethics and among medicine, other health professions, and disciplines such as philosophy complicate efforts to produce a broadly acceptable text. Finally, national and cultural differences pose major challenges to anyone trying to write for a truly international readership.The difficulty of meeting all these challenges in producing the WMA Medical Ethics Manual provides ample opportunity for criticism, especially from bioethics experts. The three expert reviewers of the manual in this issue of the journal are remarkably restrained in pointing out its shortcomings.1–3 I am grateful for both their positive evaluations and their constructive criticism. In what follows, I will respond to each of them in turn, focusing in particular on their suggestions as to how the Manual could have been improved.Before addressing these suggestions, I wish to clarify a matter raised by Søren Holm, namely, to what degree the manual …. On April 26, 1995, the United States Supreme Court limited the reach of the preemption provision of ERISA in New York State Conference of Blue Cross & Blue Shield Plans v. Tavelers Insurance Co. ). In Travelers, the Supreme Court upheld the validity of a New York statute requiring hospitals to collect surcharges from patients covered by commercial insurers and requiring health maintenance organizations to pay a surcharge to the state's general fund that varies depending on the number of Medicaid-eligible (...) HMO members enrolled. Neither patients insured by Blue Cross/Blue Shield plans nor the plans themselves are similarly charged under the statute. Several commercial insurers and HMOs claimed the surcharges should be preempted under ERISA because they are levied on patients whose insurance or HMO membership premiums are purchased by an ERISA plan.The ERISA preemption clause means that federal regulation, or lack thereof, supersedes state regulation that is related to employee pension and benefit plans. This preemption clause prevents states from changing health care and benefit law for a significant portion of state residents. (shrink)
